By downloading, installing, or using the Hurch application or visiting hurch.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian.
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Take responsibility for all activity that occurs under your account
We reserve the right to terminate accounts that violate these Terms or are inactive for an extended period.
4. Use of the Service
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Upload content that is illegal, harmful, defamatory, or infringes third-party rights
- Attempt to gain unauthorized access to any part of the Service or its systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts or bots to access or scrape the Service
- Interfere with or disrupt the integrity or performance of the Service
5. User Content
You retain ownership of all content you upload to the Service, including photos and item descriptions ("User Content"). By uploading User Content, you grant Hurch a limited, non-exclusive, royalty-free license to store, display, and process your content solely for the purpose of providing the Service to you.
You are solely responsible for your User Content and represent that you have all necessary rights to upload it.
6. Subscription and Payments
Hurch offers both free and paid subscription plans. By subscribing to a paid plan, you agree to:
- Pay all applicable fees as described at the time of purchase
- Authorize us (or our payment processor) to charge your payment method on a recurring basis
- Notify us of any changes to your billing information
Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled in accordance with the refund policy of the applicable app store (Apple App Store or Google Play).
7. Intellectual Property
The Service and its original content, features, and functionality — excluding User Content — are and will remain the exclusive property of Hurch and its licensors. Our trademarks, logo, and brand elements may not be used without our prior written consent.
8. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Hurch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time through the app settings.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
